Have you reviewed your strata scheme by-laws?

 

The newly introduced Strata Schemes Management Act 2015 requires the Owners Corporation of an existing strata scheme to review the by-laws of the scheme before 30 November 2017.

The Owners Corporation can choose to leave the by-laws as is or make some changes. It would be wise for Owners Corporations to make some changes if their current by-laws are outdated, unreasonable or inconsistent with the new legislation.

If the Owners Corporation decides on making changes, this must be done by a special resolution at a general meeting – which means getting a 75% majority of the voters present. The amended by-laws should then be lodged with the NSW Land Registry Services within 6 months of the special resolution being passed.
